ART. 13 OF EU REGULATION 2016/679
Dear Customer,
pursuant to Art. 13 of EU
Regulation 2016/679 of the European Parliament and of the Council, and in
relation to the data of which "MARTELLATO SRL" will come into
possession, we hereby inform you of the following:
Data controller
In accordance with Art. 4,
no. 7 of EU Regulation 2016/679, the Data Controller is MARTELLATO SRL, with
registered office at Via Rovigo no. 1/B - 35010 Vigonza (PD).
Purposes and legal grounds for data processing
The processing of personal
data will be carried out by MARTELLATO S.R.L. to allow us to provide
information requested in relation to the products we create and market, and for
the execution of any contract that may be concluded.
Personal data will be used for the following purposes:
- Acquisition of data and
pre-contractual information (preparation and sending of a quote, information on
the product/s and the methods of contract execution);
- Execution and management of
the contractual relationship;
- Compliance with legal
obligations related to the contractual relationship;
- Performing the operations
necessary for the management of payments and collections;
- the protection of
contractual rights;
- Management of
administrative, accounting, civil, and tax obligations.
The legal basis of data
processing is the contract as well as express consent.
Data processing methods
Processing is carried out by
means of the operations or set of operations indicated in Art. 4, no. 2 of EU
Regulation 2016/679: the collection, registration, organisation, structuring,
conservation, adaptation or modification, extraction, consultation, use,
communication by transmission, diffusion or any other form of provision,
comparison or interconnection, limitation, erasure or destruction of data.
Operations can be performed
with or without the assistance of electronic tools.
In particular, data will be
processed in paper, computerized and telematic form, and included in the
relevant databases managed by MARTELLATO S.R.L.
In particular, through the linked site, MARTELLATO S.R.L. will be able to
collect the following types of data:
a.
Browsing data
The computerised systems of
the Site collect some Personal Data, whose transmission is implicit in the use
of Internet communication protocols. This is information that is not collected
to be associated with a person, but which by their very nature could identify
the subject by means of processing activities and associations with data held
by third parties. This category includes IP addresses or the domain names of
devices to connect to the site, addresses in URI (Uniform Resource Identifier)
notation of requested resources, the time the request is made, the method used
to submit the request to the server, the file size obtained in response, the
numerical code indicating the response status from the server (successful,
error, etc.) and other parameters related to your operating system and computer
environment.
These data are used to obtain anonymous statistical information on the use of
the Site, and to verify its proper functioning; to allow, given the
architecture of the systems used, the correct delivery of the various features
that you request, for the purposes of security and assessment of responsibility
in the event of hypothetical computer crimes against the Site or third parties,
and are deleted after 7 days.
b.
Data provided voluntarily
Through the Website, the
customer has the opportunity to voluntarily provide Personal Data such as name
and e-mail address, telephone or mobile number, address at which to receive the
purchased goods, data necessary to execute the contract or allow subscription
to the newsletter, or to contact MARTELLATO S.R.L. through the "Contact
us" form. MARTELLATO S.R.L. will process these data in compliance with
applicable regulations, with the assumption that such data refer to you or
third parties who have expressly authorised you to confer them on the basis of
an appropriate legal basis that legitimises the processing of the data in
question.
Data will be processed by
individuals within the company who are authorised for this purpose by the Data
Controller and operate under its direct authority, in accordance with instructions
received.
Refusal to provide data
Any refusal to provide data
implies the impossibility for the Data Controller to perform the processing
activities indicated in the paragraph "Purposes and legal grounds for data
processing".
Communication of data and categories of recipients
The data may be made
available to subjects authorised and instructed by the Data Controller, and may
be communicated for the purposes referred to in the paragraph "Purposes
and legal grounds for data processing" to the subjects and categories of
subjects provided below:
- banking institutions for the management of collections and
payments;
- financial administrations or public institutions in the
fulfilment of regulatory obligations;
- Law firms for the protection of contractual rights.
Intention of the controller to transfer personal data to a third
country
Data may be transferred to a
third country on the basis of the adequacy decision of the scheme called the
EU-US Privacy Shield, adopted by the European Commission on 12 July 2016.

Data retention period
Data collected pursuant to
this disclosure will be retained for the entire duration of the relationship in
place with you; once this relationship has ceased, it will be retained for a
period of ten years (legal term of retention). After this period, the data will
be deleted/destroyed.
Rights of data subjects
Pursuant to EU Regulation
2016/679, data subjects have the right to the following:
- to ask the Data Controller for access to personal data, their
rectification, erasure, limitation of processing that concerns them or to
oppose the processing itself, as well as the right to data portability;
- to withdraw one's consent at any time is guaranteed; however,
data processing operations carried out based on consent given prior to the
revocation shall be legitimate;
- lodge a complaint to a supervisory authority.
Consent to the processing of data
Pursuant to Art. 6, paragraph
I(a) of the EU Regulation, by signing these documents you give your consent to
the processing of data for and with the aforementioned purposes and methods.
You also declare that you
have adequately informed your employees and have given consent to the Data
Controller for the communication of your sensitive data as per Art. 9,
paragraph I, of EU Regulation 679/2016; you also agree and become obliged to
deliver copies of the aforementioned disclosures and consent forms signed by
your employees to the Data Controller.
This consent is valid until
revoked in writing, to be sent by registered letter with return receipt,
addressed to the Data Controller at the address referred to in point 1.
Optional consent to subscribe to the mailing list/newsletter
By subscribing to the mailing
list or newsletter, your first and last name and email address are
automatically added to a list of contacts to which email messages containing
commercial and promotional information related to the activity of MARTELLATO
S.R.L., the Data Controller, may be sent.
The mailing list/newsletter
service may allow the collection of data relating to the date and time that
messages are displayed by the User, as well as data relating to the User's
interaction with them, and to clicks on the links embedded in the messages themselves.
The mailing list/newsletter
service is managed internally, and there is no transfer of data to third
countries for processing purposes.
The registration and
consequent processing of your data are considered valid until your revocation,
which is made possible through a link present in every email. If the newsletter
sending frequency is infrequent, you will be sent a communication containing
the link to cancel your subscription at least every six months.
In accordance with EU
Regulation 2016/679, you have the right to:
- to ask the Data Controller for access to personal data, their

What are cookies?
